Nobody likes to think about what happens to their home after they are gone.

But if you own a home in Southeast Michigan and you do not have a clear plan in place, your family may face a process that is more complicated, more expensive, and more time-consuming than you ever imagined.

Two of the most common ways a home passes to family members after a homeowner's death are through probate and through a trust. Understanding the difference between these two paths — and what each one means for your family and your property — is one of the most important things a Southeast Michigan homeowner can do.

What Is Probate?

Probate is the legal process through which a deceased person's estate is administered and distributed. When someone passes away and leaves behind property — including a home — probate is often required before that property can be legally transferred to heirs or sold.

In Michigan, the probate process is handled through the county probate court. The process generally involves validating the deceased person's will if one exists, appointing a personal representative to manage the estate, identifying and valuing assets including real property, paying any outstanding debts or taxes, and distributing remaining assets to heirs according to the will or Michigan intestate law if no will exists.

The Michigan probate process can take anywhere from several months to well over a year depending on the complexity of the estate, whether the will is contested, and the current caseload of the local probate court.

During that time the home still needs to be maintained, insured, and in many cases heated or cooled. Those carrying costs add up — and they come out of the estate before heirs receive anything.

What Is a Trust?

A trust is a legal arrangement in which a person — called the grantor — transfers ownership of their assets including their home to a trust during their lifetime. The trust is managed by a trustee and is designed to pass assets to beneficiaries according to the grantor's wishes after death.

The most common type used by homeowners in Southeast Michigan is a revocable living trust. With this type of trust the grantor maintains full control of the property during their lifetime and can change or revoke the trust at any time. Upon death the property passes directly to the named beneficiaries without going through probate.

This is the key distinction. A home held in a properly funded trust generally does not go through probate. That means faster transfer, lower costs, and significantly less stress for your family during an already difficult time.

Probate vs Trust — The Key Differences

Time is one of the most significant differences. Probate in Michigan can take six months to two years or longer in complex cases. A trust transfer can often be completed in a matter of weeks.

Cost is another major difference. Probate involves court fees, attorney fees, personal representative fees, and ongoing carrying costs for the property. These can consume a meaningful percentage of the estate's value. A trust involves upfront costs to establish but typically results in lower overall costs when the time comes to transfer assets.

Privacy is a consideration many families do not think about. Probate is a public process — court filings are public record and anyone can see what assets were in the estate and who received them. A trust is private.

Control is different as well. With a trust the grantor can specify exactly how and when assets are distributed — including provisions for minor grandchildren, conditions on distributions, or staggered timelines. Probate follows a more rigid legal process with less flexibility.
